3. Intellectual Property

All content on our website, including texts, images, logos, and designs, are owned by OneZeroDigital or cited from their respective owners. You may not use, reproduce, or distribute this content without permission.

However, code and design elements that we create for you become your property after full payment is received.

4. Usage Rights

You may only use our website for personal, non-commercial purposes unless otherwise agreed. It is prohibited to:

• Hack or attack the website
• Add malware or harmful code
• Use automated systems to scrape content
• Use the website for illegal purposes
• Infringe on copyrights or intellectual property rights

5. Project Agreements

When you hire us for a project, the following applies:

• Quote: Quote is valid for 30 days unless otherwise stated
• Payment: A 50% deposit is required upon signing the agreement. The balance must be paid before delivery
• Timeline: Estimated timelines are indicative and may change based on scope changes
• Scope Changes: Additional changes outside the original agreement will be billed separately
• Ownership: Ownership transfers to you after full payment

6. Warranties and Liability

Our services are provided "as-is". We do not guarantee specific results, including:

• Specific search engine rankings
• Specific traffic volumes
• Sales or profit goals

We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or revenue.

7. Hosting and Uptime

When we provide hosting services:

• We aim for 99.9% uptime
• Maintenance may take place without notice
• We are not liable for data loss due to server errors
• Regular backups are recommended

8. Support and Maintenance

Support is available based on the agreed service scope:

• Bug fixes: Critical bugs are addressed within 24 hours
• Normal requests: Are handled within 5 business days
• Maintenance: Software updates and security patches are regularly applied

9. Payment Details

Payment can be made via:

• Bank transfer (IBAN)
• Credit card (via trusted payment providers)
• PayPal

All amounts include Dutch VAT (21%) unless otherwise stated.

10. Cancellation and Refunds

Cancellation policy:

• Projects can be cancelled within 7 days of signing the agreement with full refund of the deposit
• Cancellation after 7 days results in loss of the deposit
• No refund for completed work
• Hosting and support services can be terminated monthly

11. Confidentiality

Both parties commit to confidential treatment of confidential information, including:

• Business plans
• Login credentials
• Customer personal data
• Trade secrets

12. Indemnification

You indemnify OneZeroDigital from all claims arising from:

• Your use of our services
• Your breach of these terms
• Infringement of third-party rights by your content
• Illegal or unethical activities

13. Termination

OneZeroDigital reserves the right to refuse or terminate services to clients who:

• Engage in illegal activities
• Violate our terms
• Abuse our services
• Engage in spam or phishing activities

14. Changes to Terms

We reserve the right to update these terms at any time. Continued use of our services after changes means acceptance of them.

15. Governing Law

These terms are governed by and interpreted in accordance with the laws of the Netherlands. Disputes are resolved under Dutch jurisdiction.

16. Dispute Resolution

In case of disputes:

• First, parties will negotiate in good faith
• Then the dispute will be resolved through mediation
• Finally, the dispute may be brought to court

17. No Third-Party Warranties

Our website may contain links to third-party sites. We are not responsible for the content, accuracy, or practices of these external sites. Use at your own risk.
